Clinical Negligence, Commercial Litigation and other areas

We can help you source after-the-event insurance for most types of case, including Clinical Negligence, Professional Negligence and Contract claims, either on a one-off referral basis or via a delegated authority scheme arrangement.

Unlike other companies, we provide independent, unbiased advice and aim to obtain competitive quotations from a number of insurers. Often we are able to offer deferred premiums where the premium only becomes payable in the event of success.

Clinical Negligence

We can arrange cover for clinical negligence cases on a one-off referral basis or via The Judge Clinical Negligence Options service which is our brokering service for clinical negligence delegated authority arrangements. 

With a delegated authority scheme you have the authority to issue an insurance policy for cases you handle under a Conditional Fee Agreement. At The Judge we have access to a number of the leading insurers who provide delegated authority schemes. We work closely with solicitors to ensure that they make an informed decision and choose the most appropriate scheme for their firm's needs. To date, we have arranged delegated authority schemes for a number of the leading clinical negligence firms.

The main benefits of a delegated arrangement are: 

Cheaper premiums.  Premiums under delegated arrangements are extremely competitive and generally lower than those available for individually referred cases. 
All premiums deferred and either conditional upon success or self-insured. 
Minimum administration – full delegated authority
Minimum reporting requirements – usually only required to report if you intend to reject a Part 36 Offer.
The Judge will provide full recoverability support, through expert assistance, in the event of any challenge to the premium. Our evidence has recently been accepted in the SCCO and is frequently relied upon in cost assessments/negotiations. This is an additional protection to that offered by the relevant insurer. 
The Judge Scheme Management - We can provide tailored and regular reviews of the ATE insurance market and negotiate any necessary changes during the scheme term.
Most providers offer full part 36 cover – i.e. in the event of a failure to beat a Part 36 Offer, the client’s damages are left intact.
Limits of indemnity are typically £100,00-£125,000 cover as standard for adverse costs and own disbursements.

As with any insurance scheme, there is a minimum number of cases that you will need to handle to be eligible - this can be as low as just 15 per year.

Commercial Litigation

We have a particular expertise in arranging cover for commercial cases both for cases supported by a CFA or on a private fee paying retainer.  Our staff includes former ATE Underwriters who previously specialized in commercial litigation and are therefore well versed in understanding the requirements of commercial litigators. If you are willing to act on a CFA or discounted fee arrangement there are a number of potential insurers with whom we can approach for cover.  If the case is being funded on a private fee paying basis the available options are admittedly narrowed, although provided the level of cover sought is above £50,000 there are insurance options available.

We recognize that commercial litigation can often involve high legal costs.  At the Judge we can potentially arrange cover for up to £3,000,000 of legal costs. 

If your firm undertakes a regular number of cases within a specified area with good success rates, then it can be possible to arrange delegated authority schemes for these cases.

We can potentially arrange cover for any case which is capable of being funded by a CFA.  By way of an example, we regularly arrange cover for the following types of cases:

Professional Negligence, Wills Trusts and Probate, Insolvency, Property and Land disputes, Intellectual Property, Judicial Reviews, Defamation and Group Actions to name but a few.
