Terms and Conditions
 
    1. Parties:  "thejudge.co.uk" means thejudge.co.uk Limited, its subsidiary companies and associated companies and its agents and employees. "Firm" means the firm of solicitors and its employees or other company and its employees specified as the user(s)during the subscription process.
    2. TERMS & CONDITIONS:   The Firm wishes to obtain access to one or more of thejudge.co.uk's information services provided under the name "thejudge.co.uk" (the "Services"). By using the password specified on the subscription or registration form or subsequently amended by email to access the Services, the Firm accept in full all these terms and conditions and agree to comply with them in the Firm’s use of the Services. thejudge.co.uk reserves the right to refuse a firm's request to subscribe or register to use the Services.
    3. THE FIRM’S RIGHTS:   The Firm may use Information retrieved from the Services only for the Firm’s use which means that the Firm may not sell, resell, retransmit or otherwise make the Information retrieved from the Services available in any manner or on any media to any third party (other than clients of the Firm who are given advice in respect of individual cases) unless the Firm has obtained thejudge.co.uk's prior written consent.
    4. PAYMENT:   The Firm agrees to make payment at the prevailing rate. In the event that further fee earners join the Firm after the date of subscription, making the subscription fee that would have been payable higher than the fee actually paid, no further fees will be payable by the subscribing firm. Similarly, no reduction in the subscription fee will be given if the number of fee earners in the employment of the Firm reduces after the date of subscription. For Firms which do not subscribe to the Services but which pay each time the services are accessed, The Firm agrees to pay the registration fee as specified during the registration process and the further charges when using the Services. These charges may be varied from time to time by thejudge.co.uk and any changes will be notified in advance to registered Firms.
    5. PASSWORD:   The Firm is responsible for all use of the Services made using the Firm’s password, whether or not the use is made by the Firm or another individual, firm of solicitors or other company using the Firm’s password. The Firm is responsible for protecting and securing the Firm’s password from unauthorised use. If the Firm believes there has been a breach of security of the Firm’s password the Firm should notify thejudge.co.uk. No charge will be made to the Firm for unauthorised use provided that breaches of security are reported promptly on discovery.
    6. THE FIRM’S INFORMATION:   thejudge.co.uk is a limited company incorporated in England and is registered under the Data Protection Act. All personal information the Firm supplies to thejudge.co.uk will be treated in accordance with that Act. thejudge.co.uk will itself collect and use information the Firm supplies to thejudge.co.uk in order to operate and enhance the Services. thejudge.co.uk will not pass the Firm’s information on to any other person, unless required to do so by law.
    7. AVAILABILITY OF INFORMATION:   thejudge.co.uk reserves the right to change the content, presentation, performance, user facilities and availability of any part of the Services at its sole discretion. thejudge.co.uk does not warrant any connection, transmission over, security of or results from the use of any network connection or facilities provided (or omitted to be provided) in connection with the Services.
    8. WARNING:   The Services and the Information are only for the Firm’s information and use. The Services and Information do not constitute any form of advice or recommendation by thejudge.co.uk. Any arrangement made between the Firm and any third party named in the Services is at the Firm’s sole risk and responsibility. Where the Information consists of pricing or other data, the data contained therein has been obtained from a variety of sources including the After-the-Event Insurance Providers, and other sources believed reliable. Although carefully verified, data computations and all other information provided on the Services are not guaranteed by thejudge.co.uk and may not be complete or accurate.
    9. ACCURACY OF INFORMATION:   Neither thejudge.co.uk make any warranties expressed or implied, as to the accuracy, adequacy, quality or fitness for any particular purpose of the Information or the Services for a particular purpose or use and all such warranties are expressly excluded to the fullest extent that such warranties may be excluded by law. The Firm bears all risks from any uses or results of using any Information. The Firm are responsible for validating the integrity of any Information received over the Internet.
    10. JOURNALISTIC COMMENT:   Any journalistic comment included on this site is made to the best of the knowledge and belief of the writer but no responsibility is accepted for actions based on such comment.
    11. INFORMATION POSTED BY THE FIRM:   The Firm may place Information on the Service or make it available to other users by e-mail only where and as permitted by thejudge.co.uk from time to time. thejudge.co.uk does not monitor, approve, endorse or exert editorial control over information posted by users and does not therefore accept responsibility for or make any warranties in connection with or recommend that the Firm or any third party relies on such information. The Firm agrees to not post (or transmit) (i) any information which is objectionable including, without limit, information which is defamatory, obscene, threatening, untrue or in breach of any applicable laws, rules, regulations or market conventions (including, without limit, financial services regulations), (ii) any information which is in breach of any person's rights (including without limit, copyright and confidentiality), (iii) any information or software which contains a virus, cancelbot, Trojan horse, worm or is otherwise harmful or (iv) any information which (in thejudge.co.uk's opinion) constitutes advertising. thejudge.co.uk reserves the right to remove any such information from the Services without warning and to inform and give assistance to the relevant bodies in respect of any transgressions. We accept no responsibility for and give no warranties in connection with any information posted on our site by our users. We recommend that the Firm does not rely on such information. By placing on the Services or making available to other users any information the Firm hereby grants thejudge.co.uk a worldwide non-exclusive licence to use copy, distribute, publish and transmit such information in any manner thejudge.co.uk wishes (including, without limit, archiving and making available such information as part of the Services).
    12. INDEMNITY:   The Firm irrevocably indemnifies thejudge.co.uk from and against any and all losses, damages and costs suffered or incurred by thejudge.co.uk of whatsoever nature arising out of or in connection with the Firm’s use, provision or distribution of Information or any part or the Services or any part or otherwise howsoever arising in relation to any breach of this Agreement by the Firm.
    13. HYPERTEXT LINKS:   thejudge.co.uk may provide hypertext links to sites on the Internet which are operated by other people. Using an external hypertext link means that the Firm may be leaving thejudge.co.uk's site and thejudge.co.uk therefore takes no responsibility for and gives no warranties, guarantees or representations in respect of linked sites.
    14. LIABILITY:   Due to the number of sources from which thejudge.co.uk obtains content and the nature of electronic distribution via the word wide web thejudge.co.uk has no liability (whether in contract or tort) for any losses, costs or damages resulting from or related to use of or inability to use any Information contained in the Services or the provision of the Services to the fullest extent to which such liability may be excluded or avoided by law and in no event shall thejudge.co.uk be liable to the Firm for lost profits or for indirect, incidental, special, punitive or consequential damages arising out of or in relation to the Services or the provision of Information. thejudge.co.uk makes no warranty that the Service is free from infection by viruses or anything else that has contaminating or destructive properties.
    15. TERMINATION:   This agreement will continue unless terminated in accordance with the following provisions. The Firm may terminate this agreement at any time and thejudge.co.uk may do the same. In the event of termination by either party the Firm will not be entitled to a pro-rata refund of any subscription paid, and any outstanding fees due to be paid by the Firm to thejudge.co.uk must be paid immediately on termination. If the Firm (i) fails to make any payments due to thejudge.co.uk, (ii) is in breach of any of the terms of this agreement (except for a trivial breach remedied within 7 days of its occurrence), or any generally accepted guidelines on Internet usage and etiquette (such as restrictions on mass mailings and mass advertisements, pirating or copying software, mail bombing or attempts to violate security), (iii) the Firm does or fails to do any act which jeopardises the continuance of the Services,  then thejudge.co.uk may withdraw the Services from the Firm, immediately and without notice or compensation. thejudge.co.uk will then be under no further obligation to the Firm.
    16. ASSIGNMENT:   This agreement and any rights of access (password) to any Service provided to the Firm may not be assigned, licensed or otherwise transferred by the Firm to any other person without the prior written consent of thejudge.co.uk. The Firm agrees to keep the Firm’s password confidential.
    17. COMPLETE AGREEMENT:   These terms and conditions together with the duly completed subscription form and payment method instructions, if any, are the whole agreement between the Firm and thejudge.co.uk. The Firm acknowledge that the Firm has not entered into this agreement in reliance upon any warranty or representation made by thejudge.co.uk. thejudge.co.uk may from time to time make changes to these Terms and Conditions which will be set out on thejudge.co.uk's internet site not less than 14 days before they are intended to take effect. Unless the Firm informs thejudge.co.uk that the Firm objects to the proposed change in Terms and Conditions within this 14 day period, the Firm will be deemed to accept the proposed changes.
    18. GENERAL:   Any notice from thejudge.co.uk to the Firm may be delivered by e-mail or post to the Firm at the Firm’s last known address. Evidence of posting (either electronically or otherwise) shall be taken as evidence of delivery. This agreement shall be governed by English Law. All disputes arising from or in connection with this agreement shall be subject to the non-exclusive jurisdiction of the English Courts. If any term of this agreement is held to be illegal or unenforceable the validity and enforceability of the remainder shall continue in full force and effect. The provision in question shall be replaced by a valid and enforceable term which corresponds, so far as possible, with the original. Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy. All disclaimers, indemnities and exclusions in this agreement shall survive termination of this agreement. Neither the Firm nor thejudge.co.uk shall be held liable for any loss or failure to perform any obligation hereunder due to causes beyond the Firm’s or their respective reasonable control. This agreement replaces all terms and conditions previously applicable to the provision of the Services or any of them.
